Before talking about the options of Australia Permanent Residency for Canada and USA citizens, it is important to know more about the temporary visa options an applicant from the United States of America or Canada may have compared to an applicant from another country. These temporary visa options may offer the opportunity to apply for Australia permanent residency.

When it comes to permanent visa options, it is important to realize that there aren’t any distinct visa subclass options that exist solely for the United States or Canada citizens to help them achieve Australia Permanent Residency for Canada and USA citizens.

But the options that exist to assist in getting on the pathway to Australia Permanent Residency for Canada and the USA citizens through some temporary visa options certainly do.

Exploring Australia Permanent Residency and Temporary Residency Visa Options 

Electronic Travel Authority (ETA) subclass 601

The first of these is the temporary visitor visa, the Electronic Travel Authority (ETA) subclass 601. This visa exists only to a select few nations, including Canada and the United States of America.

It allows for an applicant to be able to enter and leave Australia freely for a period of twelve months and allows the applicant to remain in Australia for a period of three months. T

Subclass 417 Working Holiday Visa

Secondly, there exists the subclass 417 Working Holiday Visa which is available to holders of a Canadian passport. However, it also has a secondary effect of enabling an applicant to find gainful employment while they are in Australia.

Subclass 462 Work and Holiday Visa

For applicants that are from the United States of America, there is a variant of the subclass 417 visa that they are able to access. This is called the subclass 462 Work and Holiday Visa. This subclass of holiday visa differs in what passport holders are allowed to apply for it, among which those from the United States are eligible to apply for.

It is otherwise similar to the subclass 417, offering an applicant twelve months within Australia and enabling them to work for an employer for a period of six month. This visa is also subject to an age limit.

The above visa subclassess are temporary visas whitch allow the visa holders to travel to Australia, learn more about the country and decide whether or not they want to stay.

This is because recently, in October 2022, Ministerial Direction 100 was put into effect. This direction emphasizes more skilled migration applicants for Australia and has been aimed with streamlining the process to further allow for more applicants to be put into priority positions.

Whilst the direction does prioritize Health and Education occupations, it also is made for aiding the growth of anyone that has a business sponsor to help grow businesses within Australia.

As applicants from the United States of America and Canada both easily qualify for many of the language requirements that are in place for permanent residency pathways within skilled and employer sponsored visa options this does mean that there is a greater demand from applicants from these locations to apply for these visa types.

Skilled Work Visa 189, 190 Permanent Migration

The legislation places emphasis on skilled visa subclasses, including the subclass 189 Skilled independent Visa, which has a direct pathway to Australia Permanent Residency; there has been a greater demand by the Australian government for more skilled individuals to be able to fill in key gaps in the market.

The subclass 190 Skilled Nominated Visa is another good option under this umbrella that is also covered under the skilled migration program. Unlike the Skilled Independent variant, however, this visa subclass is more reliant on state nomination.

However, there is a more well-regarded pathway to permanent residency that exists and also is highlighted as a specified visa subclass under the ministerial direction 100 for streamlined processing. This is to go the route of applying for a nominated occupation that is offered under the TSS 482 visa program and the subclass 482 Temporary Skill Shortage TSS Visa.

This Visa requires that an applicant have a sponsor, or in other circumstances a labour agreement, to enable them to be able to stay within Australia. Additionally, the applicant must also meet the necessary language requirement and work in a specified occupation that is apart of the eligible occupation list.

These options represent the most common pathways to Australia Permanent Residency for Canada and USA citizens and not only, but there also do exist options for those that are willing to work in more regional locations. There has been greater calls for workers to fill shortages within more rural areas around Australia.

Skilled Work Regional (Provisional) Subclass 491 Visa

In addition to the subclass 494 SESR visa, they also has the option of the Skilled Work Regional (Provisional) subclass 491. This subclass in particular presents a pathway that enables an applicant to seek permanent residence, through the subclass 191 visa Permanent Residence (Skilled Regional).

This pathway is available to an applicant that has lived and worked in a designated regional area for a period of three years.

Partner Visa

This is not a visa pathway subject to a succesful employer sponsorship or invitation to apply for a skilled visa from the Australian government. A Canadian or USA citizen who is in a genuine and ongoing relationship with an Australian citizen, permanent resident or NZ Eligible Citizen may apply for an Australian Partner Visa inside Australia or from outside Australia.
